Since the case of Liu Han and Liu Wei involved in the underworld, it has attracted great attention from all walks of life. In order to make the case a ironclad case that can stand the test of history, the public, procuratorial and legal staff involved in the case made careful preparations, held their ground and took responsibility to ensure foolproof.

Since May 2013, more than 100 police officers from Hubei Task Force have gone to Sichuan to carry out investigations around the clock, traveled to more than 10 provinces and cities, traveled hundreds of thousands of kilometers, asked more than 600 people, obtained more than 1,000 witness testimonies and collected more than 10,000 relevant materials.

The prosecution war started, and the public prosecution organ adhered to the bottom line of public prosecution that formed a complete chain of evidence. On the eve of the prosecution of the case, the case handlers were still reviewing and printing the indictment overnight. The 128-page indictment with more than 76,000 words has been revised in 46 drafts.

In addition, the public prosecution agency has also produced more than 4 million words of marking transcripts and more than 2,850 pages of trial plans. Before the trial, the public prosecutor standardized the trial plan according to four modules: interrogation, proof, cross-examination, defense viewpoint prediction and defense, and made a total of seven trial plans with more than 2,850 pages, including 170,000 words for Liu Han and Liu Wei. We sorted out 49 common problems in the procedure or cross-examination of triad-related cases, analyzed and summarized more than 110 defense opinions and defense opinions of triad-related cases, and adjusted the trial plan 18 times successively.

On February 20th, Xianning Municipal People’s Procuratorate sued the case to Xianning Intermediate People’s Court in seven cases.

Xianning Intermediate People’s Court deployed elite soldiers to form seven collegiate panels with 21 people, as well as 21 clerks and stenographers. The 14 working groups responsible for security inspection, auditing and reception guidance are in their respective positions and have their own responsibilities. There are many files, tight time and heavy tasks, and the case handlers are determined to brave the difficulties.

On February 25th, the Provincial Public Security Department arranged a deputy director to lead a special supervision class composed of the heads of public security, security and network security departments, and stationed in Xianning in advance to refine the security tasks of the trial.

This special class, together with the special class of Xianning Public Security Bureau, went deep into the scene, made on-the-spot investigation and repeated research, and worked out the overall security plan for the court trial site, the surrounding court, the escort route and the street control, and refined the security tasks, and worked out various sub-plans in different departments, stages, levels and regions to ensure "fixed personnel, posts and responsibilities".

Security inspection is the key point in court trial security work. The Provincial Public Security Department specially dispatched the Wuhan Public Security Bureau’s security inspection and explosive disposal brigade to conduct strict security inspections on five courts, seven courts and 36 prison cars, and found and eliminated potential safety hazards. During the trial, 500 special police officers and 18 sets of security inspection, explosive search and disposal equipment were deployed from 6 cities and states in the province to reinforce Xianning. In the security work, the police invested more than 3,000 police officers, dispatched more than 2,800 vehicles, and called 1,890 sets of explosion-proof protection, security inspection and explosive removal equipment.

"Please ask the bailiff to bring another suspect, Sun Moumou, to court." At 8: 36 on April 12, in the trial court of Xianning Intermediate People’s Court, the voice of the presiding judge just fell, and a middle-aged man in a wheelchair was brought into court by the bailiff. His face is sallow and he can’t stop coughing. He looks very weak.

Both the prosecution and the defense and the defendant Liu Han interrogated and asked Sun Moumou respectively. Sun moumou has clear thinking, slow speech and determined words. His testimony in court completely linked the evidence chain of Liu Han’s instigation to shoot Wang Yongcheng, locked Liu Han’s position as the mastermind and chief offender, and further proved that Liu Han was the organizer and leader of the underworld organization.

Previously, it was found by the court that Sun was hospitalized for illness and was inconvenient to appear in court. However, Liu Han and his defenders still insist that Sun Moumou must appear in court. The prosecutor also believes that if Sun Moumou himself can appear in court, it will help to find out the facts. In order to ensure that the case can stand the test of law and history, leaving no regrets and sequelae, the political and legal organs overcame many difficulties and formulated careful safeguard measures to win the appearance of Sun Moumou, who was detained in Beijing for another case.

During the trial, according to the application of both the prosecution and the defense and the specific case, the collegiate bench constantly adjusted the trial agenda, invited new witnesses to appear in court, and the collegiate bench gave cross-evidence. In the case of Liu Han, the suspects Sun Moumou and Yang Xue and the defendant Liu Wei were added to appear in court, and the defendants Liu Xuejun, Liu Zhongwei and Lv Bin were added to the case of Liu Wei. At the request of the defender, the "Er Liu" case showed the black bullets three times and handed them over to the defendant for identification.

From March 31st to April 19th, at the trial site, Liu Han missed every opportunity to speak. "I don’t know this person", "I don’t know this matter" and "It has nothing to do with me" … Liu Han often talks about these accusations.

At the scene of the trial, he played "sad cards", "good cards" and "hypocritical cards" to gain sympathy. In this regard, the presiding judge rope Wanxun repeatedly sounded the gavel to remind him to pay attention to emotions and wording, so as to smoothly and orderly advance the trial process.

Among the 36 defendants, most of them are junior high school students and lack language skills. At the scene of the first trial court of Xian ‘an District People’s Court in Xianning City, the defendants Yuan Shaolin and Zhang Donghua raised their hands several times in the process of giving evidence and cross-examination, but they were incoherent when they opened their mouths. Wang Weimin, the presiding judge, always guided patiently and clarified or implemented the facts advocated by the parties by asking questions. In this regard, many defendants thanked in court.

During the trial, both the prosecution and the defense debated many times, and the seven presiding judges were able to assess the situation, combining rigidity with softness, and interpreted the people’s judges’ judicial literacy of strict law enforcement, fair trial and tolerance with neutral, modest and rational words and deeds. Under the education, influence and deterrence of the court, most defendants pleaded guilty and repented in court, and expressed their remorse to the relatives of the victims.

In the stage of inspection and prosecution, the procuratorate contacted the judicial administrative department in time and appointed eight defense lawyers for many defendants who did not entrust defense lawyers for various reasons. When collecting evidence, it not only consolidates and reinforces the guilty evidence, but also collects the evidence that the crime is lighter, so as to fully protect the defendant’s litigation rights. Should Liu Han be executed for his crime?

On the 23rd, 36 people, including Liu Han and Liu Wei, were sentenced in the first instance. Defendant Liu Han committed crimes such as organizing and leading underworld organizations and intentional homicide, and was sentenced to death, deprived of political rights for life, and confiscated all his personal property. As the organizer and leader of the underworld criminal group, should Liu Han be put to death? Yesterday, our reporter interviewed Liu Zhixiong, a professor at the Law School of South-Central University for Nationalities and vice president of Hubei Criminal Law Research Association.

Reporter: What is the basis for the court of first instance to sentence Liu Han to death?

Liu Zhixiong: The court sentenced Liu Han to death on the basis of his intentional homicide. After trial, the court found that Liu Han’s behavior constituted 13 kinds of crimes, among which, he was sentenced to death for intentional homicide and deprived of his political rights for life. According to the provisions of the Criminal Law on combined punishment for several crimes, he decided to execute the death penalty, and the main punishments sentenced for other crimes were no longer executed.

There are two main legal grounds for Liu Han’s death sentence: first, the death penalty for intentional homicide in Article 232 of the Specific Provisions of the Criminal Law; Second, Article 48 of the General Principles of Criminal Law stipulates that the death penalty is only applicable to criminals with extremely serious crimes. Judging from the facts ascertained by the court, Liu Han instigated, condoned and recognized five crimes of intentional homicide committed by members of underworld organizations led by his organization, resulting in six deaths. His means were cruel, his subjective malignancy was extremely deep, and his social impact was extremely bad. It can be said that the crime was extremely serious and he should be sentenced to death according to law.

Reporter: In five cases of intentional homicide, Liu Han didn’t directly commit crimes, and even in some cases, he didn’t directly organize crimes. Why did the court hold him criminally responsible for five cases of intentional homicide?

Liu Zhixiong: Judging from the facts identified by the court, in two of the five cases of intentional homicide, Liu Han had a clear intention to kill his men, and it was not a problem to identify him as a criminal organizer of intentional homicide. In the other three cases, although Liu Han did not directly organize and carry out the murder, Liu Han, as the ringleader of the criminal group, should be punished according to all the crimes committed by the group, which is clearly stipulated in Article 26 of the Criminal Law. According to the facts identified in the judgment and the provisions of the law, Liu Han has constituted the crime of organizing and leading an underworld organization. The underworld organization belongs to a criminal group in criminal law, and Liu Han belongs to the ringleader of the criminal group. He bears criminal responsibility for all the crimes committed by the group, which is in line with the express provisions of the criminal law and the basic principles of criminal law. Therefore, it is not a problem to take the other three cases of intentional homicide committed by the group as the basis for punishing Liu Han.

Reporter: There are many perpetrators involved in the five murders. If the responsibility for the criminal harm is decomposed into various criminals, does it mean that some of them are sentenced to death?

Liu Zhixiong: The characteristic of joint crime is that the actions of the joint criminals involved in the crime constitute a whole. Although each person’s specific division of labor is different, and each person only plays a part in it, it is the behavior of each participant that forms an interconnected whole and jointly becomes the cause of harmful results. This means that every member should be responsible for the result of the crime. This is the meaning of "partial behavior, full responsibility" in criminal law theory, that is to say, even if you only carry out part of the behavior, you are still responsible for the harmful results of the whole joint crime. Therefore, in joint crime, the responsibility for the result is not divided into individual persons, but the responsibility for the result of the whole joint crime is assumed according to the role played by the joint offender. That is to say, Liu Han can’t reduce his responsibility for the harmful results because there are many people involved in the murder. On the contrary, the greater the number of participants, the greater the threat it poses to the legitimate rights and interests. Moreover, as the ringleader of the criminal group, Liu Han plays the most important role in the whole joint crime, and it is natural to assume the most important responsibility.

Therefore, judging from the facts identified by the court of first instance, it is appropriate to sentence Liu Han to death. Of course, this is based on the judgment of the first instance. Liu Han also has the right to appeal. The appeal will be conducted in the second instance, and there will be a death penalty review procedure after the second instance. If mistakes in fact finding or law application are found in the second instance and the death penalty review procedure, that is another matter.

  First, to ensure the comprehensive development of land

  (a) the people’s governments of cities and counties along the newly-built railway projects should actively support and guarantee the scale of land for comprehensive development of the project, and adjust the overall land use planning according to the implementation schedule of comprehensive development. Railway projects supporting the comprehensive development of land required for new construction land indicators, by the Provincial Department of Land and Resources to the Ministry of Natural Resources to apply for separate planning or the use of provincial reserved indicators.

  (II) In the planning and site selection stage of railway projects, the people’s governments of cities and counties along the line should implement planning control on the land within a radius of 800 meters centered on the station in a timely manner, and determine the land within a radius of about 800 meters from the center of the station as an alternative land for development in combination with the actual situation of cities, towns and urban road networks.

  (3) After the approval of the feasibility study report of the railway project and before the approval of the comprehensive development plan of the station land, suspend the acceptance and issuance of the planning permission for construction land or issue the conditions for land planning and design, and suspend the transfer and allocation of land; If it is really necessary to carry out national and provincial key projects or major livelihood projects, environmental protection projects and the construction of "three old" reconstruction projects before the railway project planning and site selection is determined, the people’s government at the prefecture level or above shall apply to the Provincial Department of Land and Resources for a special topic, and the Provincial Department of Land and Resources shall take the lead in making a decision jointly with relevant provincial departments.

  (four) after deducting the station land, the total amount of land for comprehensive development of the same railway project is controlled according to the average size of a single station not exceeding 50 hectares, and the scale of land for comprehensive development of a few stations is not exceeding 100 hectares.

  Second, strengthen planning and convergence

  (5) For newly-built railway projects, the people’s governments at the prefecture level or above the city level where the project is located shall co-ordinate the organization of the project construction investors or project companies at the feasibility study stage of the project, and simultaneously prepare the comprehensive development plan for the station land. For stations (large-scale comprehensive transportation hubs) involving multiple railway projects, the Provincial Development and Reform Commission should strengthen guidance and coordination to take into account the comprehensive development needs of various railway projects. For existing railway projects, the people’s governments at the prefecture level and listed along the line should take the initiative to negotiate with the legal entity of the railway project and make overall plans for the comprehensive development of the station land. The comprehensive development planning of the station land should be coordinated with the overall land use planning and the overall urban planning, and the adjustment of the overall land use planning and the overall urban planning should be handled in accordance with the regulations.

  (VI) The comprehensive development plan of station and yard land should be compiled according to the principle of "integrated design, unified joint construction, three-dimensional development and functional integration", and the location, scope, scale and development conditions of land for comprehensive development of land should be defined, so as to promote the coordination of the layout of station and yard and related facilities, seamless connection of transportation facilities, full utilization of above-ground and underground space, greatly improve the transportation function and comprehensive service function of cities, form a benign interaction mechanism between railway construction and the development of towns and related industries, and promote railway traffic.

  (7) The comprehensive development plan of station land shall be compiled according to the line (project) substation, and the opinions of the people’s governments of counties (cities, districts) along the line shall be fully solicited, and shall be submitted to the Provincial Department of Housing and Urban-Rural Development, the Development and Reform Commission and the Department of Land and Resources for joint approval and implementation according to procedures. The people’s governments of counties (cities, districts) along the line shall prepare or adjust the regulatory detailed planning of relevant land use in a timely manner, and the relevant adjustments shall be made after soliciting the written opinions of the project construction investment subject (or project company) in advance, and then perform the relevant examination and approval procedures. In principle, the planning adjustment shall be completed within 6 months and reported to the Provincial Department of Housing and Urban-Rural Development step by step for the record.

  Third, promote the comprehensive development and utilization of land

  (eight) the use of land within the red line of railway projects for the development of above-ground and underground space, under the premise of meeting the planning and safety requirements of railway projects, can be compatible with a certain proportion of other functions, and can set up the right to use construction land in layers. The right to use the construction land established by layers conforms to the Catalogue of Allocated Land, and the procedures for land use can be handled according to the allocation method; Do not meet the "allocation of land directory", according to the agreement for paid land use procedures. If the allocated land obtained by the legal entity of railway project according to law is no longer in conformity with the Catalogue of Allocated Land due to transfer or change of use, the land use formalities can be handled by agreement according to the provisions of Document No.37 [2014] of the State Council Office; If the development is recovered by the government, it can be implemented with reference to the redevelopment of inefficient land and the relevant policies of "three old" transformation.

  (9) Support legal entities of railway projects to make use of their own land, acquire adjacent land through equal consultation, obtain land supplied by the government according to law or cooperate with other market entities to comprehensively develop the existing railway project station area. After the approval of the planning department, the land and resources departments of cities and counties along the line shall provide services for the railway project legal entity to use its own land for land property rights integration and parcel merger and split.

  Fourth, clear the way of land supply

  (ten) the comprehensive development of new railway stations and yards shall be supplied in a market-oriented way, and the announcement time for land supply shall not be less than 60 working days. If the investment subject of the newly-built railway project is not determined, the comprehensive land development right can be tendered together when the project is tendered, and the winning bidder of the newly-built railway project can obtain the comprehensive land development right at the same time, and the corresponding land can be provided once or in stages according to the development stages, and the land supply price is determined according to the market price at the time of transfer. The new railway project has determined the investment subject but not the comprehensive land development right. If the land conforms to the Catalogue of Allocated Land, it can be supplied by allocation; If it does not conform to the Catalogue of Allocated Land, it will be supplied by bidding, auction and listing, and the unified railway station, line engineering, related planning conditions and railway construction requirements will be taken as the preconditions for obtaining land. To supply land within the scope of comprehensive development of existing railway stations and yards, the planning requirements of comprehensive development and the requirements of railway construction should be included in the premise of land supply.

  (11) All localities can explore the way of "providing land in pieces and supplying it by stages" for comprehensive land development, that is, referring to the current bidding, auction and listing mode, the right to use the land for comprehensive land development and the transfer price are determined first, and the procedures of signing the transfer contract and paying the transfer fee in the bidding, auction and listing procedures are temporarily not fulfilled. After determining the owner of the right to use, the remaining land supply process will be handled by stages according to the urban planning and actual situation, and the price of land supply by stages will be implemented according to the price determined at the time of bidding, auction and listing. The time limit for land supply by stages shall not exceed 5 years at the longest. If the land supply by stages cannot be completed within 5 years due to the reason of the land use right holder, the land supply procedures for the remaining land shall not be handled for the land use right holder.

  Five, reasonably determine the cost of land use

  (12) For industrial projects that are in line with the province’s priority to develop industries and are intensive in land use (the floor area ratio and building coefficient exceed the national standard by 40% and the investment intensity increases by more than 10%), the transfer reserve price can be determined by not less than 70% of the lowest price standard of industrial land corresponding to the local land. Land comprehensive development and construction of real estate (including commercial buildings, office buildings, etc.) needs to be sold by means of bidding, auction and listing, and the selling reserve price shall be determined by collective decision based on the land appraisal results, land supply policies and land market conditions. The lowest price of land transfer shall not be less than 70% of the benchmark land price at the location of the land transfer, and the bid bond shall not be less than 20% of the lowest price of land transfer. Encourage the intensive use of space, and the reserve price of the right to use underground space can be calculated and determined by multiplying the benchmark price of the local level by the corresponding correction coefficient. The specific correction coefficient is determined by the people’s governments of cities and counties according to local actual conditions.

  (13) The land authorized by the state to operate can be invested (invested) or leased at a fixed price according to law within the service life, or privately transferred between state-controlled and state-controlled enterprises within the group company after being examined and approved by the state-funded enterprises.

  Six, the establishment of a comprehensive security mechanism

  (fourteen) to promote the establishment of "railway projects+land development" comprehensive return model. After the income from comprehensive land development is included, the financial internal rate of return of railway projects should not be lower than the industry benchmark value of 3% in principle, and it should be comprehensively determined in combination with the recruitment of social capital. The number of comprehensive development land provided by listing at all levels along the railway project should match the sustainable management responsibility of the project shared by the road sections in each city; The income from comprehensive land development is accounted for by cities, which is used for the sustainable management of projects in the city’s sections.

  (15) The municipal government at or above the prefecture level along the railway project shall, in accordance with the principles of integrated planning, linked supply, three-dimensional development and overall construction, negotiate and determine the comprehensive land development matters that need to be arranged for the construction of railway stations and yards, and clarify the related matters such as the comprehensive land development projects and the unified joint construction of corresponding railway stations and yards and line projects. Before the feasibility study of a new railway project is approved, the investment subject of railway project construction and the prefecture-level listing along the line should sign a comprehensive land development agreement, and clarify the scale, location, supply and payment method of the feasibility gap subsidy for the comprehensive development land. Increase credit support for eligible government and social capital cooperation (PPP) projects, and provide long-term, stable and low-cost financial support for the projects.

  (sixteen) to support the comprehensive development of land for the construction and operation of railway projects. After deducting the necessary costs such as land purchasing and storage and the rigid provision stipulated by the state and province, the rest of the land transfer income can be used for railway project construction and operation. For the railway project built in the mode of "railway project+land development", the people’s governments at the prefecture level and listed cities along the line where the land is sold can arrange special subsidy funds from the comprehensive land development income to the project company according to the requirements of the two lines of revenue and expenditure and the comprehensive development agreement signed with the project construction investors, so as to improve the fund-raising ability and income level of the railway project. The Pearl River Delta intercity railway project, which is built in a mode other than "railway project+land development", will continue to do a good job in collecting the income from comprehensive land development of the Pearl River Delta intercity railway project, and the relevant municipal governments and provincial departments in the Pearl River Delta should implement the development income management in accordance with the specific requirements of the Measures for the Administration of Operation Guarantee Fund for the Pearl River Delta Intercity Rail Transit Project. After the main body of railway project construction completes the construction of the upper cover plate of the station yard, rolling stock depot and parking lot, if it is really necessary to be purchased and stored at the prefecture level along the line, the land reserve department at the prefecture level along the line will sign a compensation agreement with the main body of railway construction, and the compensation standard for purchasing and storing can be implemented with reference to the relevant provisions of the "three old" transformation.

In the case of shortage of funds, License-out is obviously a better choice than selling assets. As an authorized party, pharmaceutical companies can continue to obtain more milestone benefits.

For the seller, financing is difficult at present, and it is urgent to obtain funds for the company to continue its life through License-out; For the buyer, pipeline authorization can be obtained at a cheaper price during the downturn of the industry.

Behind the buyers and sellers, there is another role that drives these transnational transactions — — Investors.

In the innovative drug market, China pharmaceutical companies have changed their roles from License-in to License-out, which is behind the accelerated transformation and upgrading of China pharmaceutical industry. From the perspective of commercialization, it is also the only way for domestic innovative pharmaceutical companies to go to sea.

According to the data quoted by BCG from EvaluatePharma, the global innovative drug market is about 830 billion US dollars in 2021, of which the US market accounts for 55%, while China’s innovative drug market only accounts for 3% of the global market.

According to BCG data, in 2021, the sales of innovative drugs in the United States accounted for 79% of all drug sales, while the sales of innovative drugs in China only accounted for 11% of the national drug sales. Comparing the medical security systems of China and the United States, the commercial medical insurance in the United States accounts for 40.14% of the total health insurance expenses. Choosing innovative drugs that go out to sea has obviously achieved a higher profit return on single products.

In the domestic market, innovative pharmaceutical companies are bound to face the game of medical insurance negotiation.

Zhou yun (a pseudonym), an industry insider with rich experience in medical insurance, told Jianwen Consulting that in recent years, the price reduction of drugs involved in national medical insurance negotiations is usually more than 60% or even higher. In order to master more chips in the negotiation, pharmaceutical companies often raise the price of drugs, leaving room for an average price reduction of 60%.
